Terms of Service
These Terms of Service ("Terms") govern your access to and use of the Lynq website (lynq.jobs) and platform (app.lynq.jobs), collectively referred to as the "Service," operated by Lynq ("we," "us," or "our").
By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 16 years old and have the legal authority to enter into these Terms. If you use the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.
2. Account Registration
- You must provide accurate and complete information when creating an account.
- You are responsible for maintaining the confidentiality of your account credentials.
- You are responsible for all activity that occurs under your account.
- You must notify us immediately of any unauthorized use of your account at security@lynq.jobs.
3. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable laws or regulations.
- Upload, post, or transmit content that is fraudulent, misleading, defamatory, obscene, or otherwise objectionable.
- Attempt to gain unauthorized access to any part of the Service, other accounts, or related systems.
- Interfere with or disrupt the integrity or performance of the Service.
- Use the Service to send unsolicited communications (spam).
- Scrape, crawl, or use automated means to extract data from the Service without our written consent.
- Reverse engineer, decompile, or disassemble any part of the Service.
- Post discriminatory job listings or use the Service in a manner that violates employment laws.
4. Your Content
"Your Content" includes job listings, candidate data, company information, and any other content you upload, submit, or create through the Service.
- You retain all ownership rights to Your Content.
- You grant us a limited, non-exclusive license to use, store, and process Your Content solely for the purpose of providing and improving the Service.
- You represent that you have all necessary rights and permissions to upload Your Content, including compliance with applicable data protection laws regarding candidate data.
- We do not claim ownership of Your Content, and we will not use it for purposes unrelated to the Service.
5. Candidate Data Responsibilities
When you use the Service to manage candidate information:
- You are the data controller for candidate personal data you process through the Service.
- You are responsible for ensuring you have a lawful basis to collect and process candidate data.
- You must comply with all applicable data protection and employment laws in your jurisdiction.
- We act as a data processor on your behalf and will process candidate data only as instructed by you and as described in our Privacy Policy.
6. Fees and Payment
- Certain features of the Service may require payment. Pricing and payment terms will be communicated before you incur any charges.
- All fees are non-refundable unless otherwise stated or required by law.
- We reserve the right to change our pricing with 30 days' notice.
- Failure to pay may result in suspension or termination of your account.
7. Intellectual Property
The Service, including its design, features, code, and branding (excluding Your Content), is owned by Lynq and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the Service without our written permission.
8. Availability and Modifications
- We strive to keep the Service available but do not guarantee uninterrupted or error-free access.
- We may modify, suspend, or discontinue any part of the Service at any time with reasonable notice.
- We are not liable for any downtime, data loss, or service interruptions.
9. Termination
- You may stop using the Service and request account deletion at any time by contacting us.
- We may suspend or terminate your account if you violate these Terms, with notice when practicable.
- Upon termination, your right to use the Service ceases. We will delete your data within 30 days, unless retention is required by law.
- Sections 7, 10, 11, and 12 survive termination.
10. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, LYNQ AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, REGARDLESS OF THE THEORY OF LIABILITY.
OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) $100 USD.
12. Indemnification
You agree to indemnify, defend, and hold harmless Lynq and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) Your Content.
13. Governing Law and Disputes
These Terms are governed by the laws of the State of Nevada, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved in the state or federal courts located in Clark County, Nevada.
14. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Continued use of the Service after changes constitutes acceptance. If you disagree with updated Terms, you must stop using the Service.
15. General
- Entire agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and Lynq.
- Severability: If any provision is found unenforceable, the remaining provisions remain in effect.
- Waiver: Failure to enforce any right does not constitute a waiver of that right.
- Assignment: You may not assign these Terms without our consent. We may assign our rights and obligations without restriction.
